Foreword
The company UNSEENLABS (hereinafter, "UNSEENLABS") publishes and makes available to Users UNSEENLABS’ website via the following URL: https://unseenlabs.com/ (hereinafter, the “Site”) displaying the services provided by UNSEENLABS.
The protection of your personal data is fundamental to UNSEENLABS, that ensures their confidentiality and integrity by implementing the necessary means to guarantee their protection, non-alteration, availability and security.
It is within this framework that the UNSEENLABS’ privacy policy has been drafted (hereinafter, the "Privacy Policy").

1. OBJECT OF THE PRIVACY POLICY
1.1. Definitions
For the purpose of the Privacy Policy, the following terms beginning with a capital letter shall have the following meanings:
”Personal Data“: means any information that directly or indirectly identifies you. Common examples include: name, username, phone number, photograph, date of birth, city of residence.
“User(s)”: means any user of the Site also referred to as “you”.
1.2. Scope of the Privacy Policy
This Privacy Policy applies to UNSEENLABS’ policy regarding the collection and use of your Personal Data when browsing and using the Site.
It covers (I) the origin and nature of the data collected by UNSEENLABS, (II) the purpose for its collection, (III) the way UNSEENLABS makes use of the data and (IV) your rights regarding the data pursuant to Act 78-17 of January 6, 1978, known as the “French Data Protection Act“, and EU Regulation no.2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, known as the “GDPR”, (hereinafter together referred to as the “Applicable Regulations”).
The Privacy Policy is particularly important to ensure that you have a positive and confident experience when browsing the Site, and to allow us to accurately and fully answer your questions about the collection and use of your Personal Data.
The Privacy Policy does not apply to third party websites to which you may be redirected when using the Site, especially the platforms (e.g. We recruit), networks and social media or content platforms on which UNSEENLABS has created an account or to which the User may be redirected to access certain content (e.g. Instagram, LinkedIn, X, YouTube, Vimeo, etc). We recommend that you refer to the legal notices and privacy policies of these sites.
Finally, considering how fast web technologies are evolving, changes may be made to the Privacy Policy from time to time. We therefore recommend that you refer back to its content on a regular basis.
By using the Site, you hereby declare that you have understood and unreservedly agree to the terms of this Privacy Policy.
2. COLLECTION OF YOUR PERSONAL DATA
2.1 Obtaining your consent
To achieve the purposes listed in Article 5 of the Privacy Policy, UNSEENLABS may create a file consisting of Personal Data transferred when filling in forms on the Site and/or subscribing to the UNSEENLABS newsletter.
You are hereby informed of the terms and conditions under which UNSEENLABS processes your Personal Data.
You may provide your prior and explicit consent for UNSEENLABS to collect and process your Personal Data when using the Site, submitting forms (e.g., the contact form, use case/white paper form, application form, webinar registration form, appointment form, etc.), and/or subscribing to the UNSEENLABS newsletter, in accordance with the terms of the Applicable Regulations (particularly through the use of checkboxes).
You are informed that UNSEENLABS may process certain Personal Data within the scope of the performance of a contract binding you to UNSEENLABS, within the scope of the exercise of a legitimate interest or in compliance with legal provisions, without the need to express your prior consent.
The list of legal grounds for the processing operations carried out by UNSEENLABS is in Article 5 “Use of your Personal Data”.
2.2 Personal Data collected by UNSEENLABS
UNSEENLABS may directly collect from you the following Personal Data when filling in a form, or by e-mail or postal mail:
- Your title,
- Your first name and last name,
- Your profession and the name of your company,
- Your email,
- Your address,
- Your phone number,
- Personal Data that could potentially appear on your resume.
When we collect Personal Data via our forms, the Personal Data subject to mandatory collection is flagged up with the symbol (*) in front of the box to be filled in the form or by any other system.
2.3 Personal Data collected indirectly by UNSEENLABS
Certain services operated by third parties (e.g. We Recruit) may be integrated into the Site or accessible from the latter (e.g. forms). In this context, UNSEENLABS may indirectly collect your Personal Data as mentioned above from these third parties, when you fill in a form proposed by these third parties on the Site (e.g. the contact form, the use case/white paper form, the webinar registration form, the appointment form, etc.) or an other platform (e.g. dedicated recruitment platform) or by subscribing to the UNSEENLABS newsletter.
3. COLLECTION OF USAGE DATA
These data relate to your use of the Site and include information such as the features you use and the frequency and duration of your activities on the Site.
We may collect information from the devices (such as computers, laptop, phones, tablets or other devices) on which you use the Site, depending on your permissions and settings. This information may, fo instance, include your IP address, device ID, browser and software characteristics (such as operating system type and version or language setting).

- The type and version of the browser software used by a device (Internet Explorer, Safari, Chrome, etc.),
- The language of the browser software used by the device.
A cookie is a non-executable text file installed on your device when browsing the Internet.

When browsing the Site, a control panel is displayed and gives you the possibility to consult the purposes of cookies or other identifiers and to configure your choices concerning the consent or refusal to the installation of cookies or other identifiers.

Any Personal Data that UNSEENLABS collects directly or indirectly from you, especially when using the Site, filling in a form (e.g. the contact form, the use case/white paper form, the application form, the webinar registration form, the appointment form, etc.), subscribing to the UNSEENLABS newsletter or by e-mail or postal mail, is liable to be processed for the following purposes:
Carrying out “customer management” operations relating to:
- Your requests (e.g. request for information or a quote; access to use cases /white papers published on the Site), registration to a webinar, request for an appointment),
- Monitoring “customer relations” (such as conducting satisfaction surveys, polls, managing complaints, etc.).

UNSEENLABS does not sell your Personal Data to its partners or to third party service providers.
6. SHARING OF PERSONAL DATA
UNSEENLABS ensures the confidentiality of your Personal Data but may disclose Personal Data to the following people/entities:
- UNSEENLABS staff in charge of the communication department, the marketing department, the commercial department, the technical department in charge of the deployment of the Site, the department in charge of customer relations, administrative services, legal department, internal auditing procedures services, logistical services and IT services, as well as any managers of those services,
- Data processors offering sufficient guarantees as regards the security and confidentiality of Personal Data in compliance with the Applicable Regulations,
- Any company controlled by UNSEENLABS, controlling the latter or under common control within the meaning of article L233-3 of the French Commercial Code (“Code de commerce”), as well as any company that may take a controlling interest in our company (acquisition of a majority shareholding, partial contribution of assets, transfer of business, merger and acquisition, or any other such circumstance),
- Suppliers of services to UNSEENLABS, in particular marketing service providers,
- Any competent court or law enforcement authority or agency, when such disclosure is required by court order or other legal process,
- The CNIL (French Data Protection Authority) and any other body with jurisdiction.
7. SENDING INFORMATION
7.1 Similar services to those previously provided to you
UNSEENLABS may send you notifications directly by e-mail about UNSEENLABS, the Site or about UNSEENLABS services similar to those we have provided to you under a prior agreement between UNSEENLABS and you.
You can object to receiving any new queries at any time, free of charge, via the hypertext link contained in the e-mails sent by UNSEENLABS or exercise your rights under the terms of Article 9 hereinafter.

By subscribing through our online forms, you can request to receive the UNSEENLABS newsletter.
You can object to receiving further newsletters at any time, free of charge, via the hypertext link contained in the newsletter e-mails sent by UNSEENLABS or exercise your rights under the terms of Article 9 hereinafter.
8. DATA STORAGE PERIOD
We store your Personal Data during the use period of the Site as long as it takes to provide our services.
For Personal Data used for commercial information or prospecting purposes, we keep them for a period of three (3) years (i) from the end of the commercial relationship for client Users or (ii) for prospective Users, from their collection or the last contact from the said prospective User.
Regarding job applications, we store the Personal Data for a period of two (2) years from the date of the last contact with the applicant.
You can unsubscribe from any UNSEENLABS mailing lists by exercising your rights as listed below.
You acknowledge that we only retain your Personal Data in our information system for legitimate administrative, legal and security purposes.
The storage of your data beyond the term specified in Article 5 “Use of your Data” may be necessary to carry out your requests to oppose, restrict the processing operations and delete your Personal Data and to comply with any legal, accounting or tax obligation to store personal data (e.g. for the provision of evidence) or to transfer it to the relevant authorities (civil service, police services, etc.).
Throughout the Personal Data storage period, UNSEENLABS undertakes to maintain a high level of security and privacy of the Personal Data, to restrict access only to authorized people and not to process it for purposes other than those agreed upon herein.
9. INFORMATION AND EXERCISING YOUR RIGHTS
Pursuant to the Applicable Regulations and in particular to articles 15 to 22 of the GDPR, you have a right to:
- Send us any request for information about the Privacy Policy and the processing of your Personal Data,
- Access information about the processing of your Personal Data (data category, purposes, etc.),
- Rectify or update any inaccurate Personal Data by sending us an e-mail,
- Erase your Personal Data by sending us an e-mail,
- Restrict any processing of your Personal Data that we undertake, if you believe the data to be inaccurate (for a limited period during which we will check the accuracy of the data), or if you believe the processing to be unlawful (while allowing us to continue), by sending us an e-mail,
- Receive a copy of the Personal Data you have provided directly to us, in a structured, commonly used and device-readable format, by sending us an e-mail; it being specified that any request for a copy beyond the first one may generate administrative processing costs that will be charged to you. You are informed that Personal Data that is derived, calculated or inferred by us from the data you provide to us is excluded from the right to data portability, insofar as it is not provided by you but created by us,
- Unsubscribe from the UNSEENLABS newsletter mailing list by clicking on the dedicated hyperlink in the information e-mail,
- Decide not to be subject to automated decision-making: the right not to be subject to a decision based solely on automated decision-making, including profiling, where the decision would have a legal effect on you or a similar significant effect,

In the event of excessive claims, particularly of a repetitive nature, we reserve the right not to follow up any requests for access once we have satisfied one of your requests for access to your Personal Data.
Your requests must be submitted in writing by post mail or by email sent to the addresses shown below, be signed and enclose a photocopy of an ID document bearing the holder’s signature. The request must specify the address to which the reply should be sent. We are bound to reply within one (1) month of receiving the request. This deadline may be extended by two (2) months, in the event of a large number of particularly complex requests.

10. SECURITY AND PRIVACY
UNSEENLABS, as data controller, implements organizational and technical security measures designed to safeguard the privacy and integrity of your Personal Data.
Operating and administration UNSEENLABS environment security measures:
All Personal Data stored on UNSEENLABS servers is protected by the following measures:
- Dedicated UNSEENLABS network,
- Access rights management,
- Password-protection policy and password lockout,
- Use of antivirus and intrusion detection protection,
- Firewall protection of each network zone,
- Limitation of the number of authorized requests to prevent abnormal or abusive use of the Site.
User environment security measures:
All Personal Data stored on UNSEENLABS servers is protected by the following measures:
- Hosting of Personal Data in data center within the European Union,
- Encrypted database,
- Cloud provider with numerous security certifications,
- Use of antivirus,
- Access management,
- Protection of hosted sensitive files from malicious direct access,
- Limitation of the number of authorized requests to prevent abnormal or abusive use of the Site,
- Verification of the email address of the Users, in case of fraud or suspicious form, the access can be suspended manually.
However, given the very nature of a public network such as the Internet, you acknowledge and accept that we cannot guarantee the security of Personal Data transmission and data integrity.
In the event of a security breach resulting in a violation of Personal Data in accordance with the provisions of the Applicable Regulations, we will inform you of the nature of the breach and the likely consequences.
We undertake to take the necessary corrective measures and to notify the CNIL (the French Data Protection Authority) of the violation, unless the said violation is liable to jeopardize the rights and civil liberties of natural persons, pursuant to the Applicable Regulations.
11. PERSONAL DATA STORAGE LOCATION
UNSEENLABS hosts and has your Personal Data hosted within the European Union.
Should the data processing operations and the purposes under Article 5 require the transfer of Personal Data outside the European Union, UNSEENLABS will ensure that your Personal Data has efficient protection.
All data transfers would be to located recipients:
- In countries which, according to the criteria established by the European Commission, provide an adequate level of personal data protection,
- In countries where the transfer is covered by the standard contractual clauses for data transfers between EU and non-EU countries provided by the European Commission or by binding corporate rules.
12. CHANGES IN THE PRIVACY POLICY
We may modify our Privacy Policy from time to time. We will notify you of any significant changes by a notice displayed on the Site, or by e-mail, so that you can examine the modifications before they come into effect.
If you continue to visit the Site after we have posted or sent a notification relating to modifications of our Privacy Policy, you shall be deemed to have unreservedly accepted the updated Privacy Policy.
